Policy 5517: Student Anti-Harassment

Any person may report sex discrimination, including sexual harassment (whether or not the person reporting is the person alleged to be the victim of conduct that could constitute sex discrimination or sexual harassment), in person, by mail, by telephone, or by electronic mail using the Title IX Coordinator's contact information listed above, or by any other means that results in the Title IX Coordinator receiving the person's oral or written report. Reports may be made at any time (including during non-business hours), by using the telephone number(s) or electronic mail address(es), or by mail to the office address(es), listed for the Title IX Coordinator(s).

A formal complaint may be filed with the Title IX Coordinator in person, by mail, or by electronic mail, by using the contact information set forth in Policy 2266: Nondiscrimination on the Basis of Sex in Education Programs or Activities.
As required by the federal Title IX regulations, the District has established a formal grievance process for investigating and resolving "formal complaints" of "sexual harassment", as those terms are defined in the regulations. To assist persons reporting formal complaints of sexual harassment involving students, the "Formal Student Discrimination or Discriminatory Harassment Reporting Form" should be completed and submitted to the Title IX Coordinator.

When a report of sexual harassment is made, the Title IX Coordinator shall promptly contact the Complainant (including the parent/guardian if the Complainant is under eighteen (18) years of age or under guardianship) to discuss the availability of supportive measures, consider the Complainant's wishes with respect to supportive measures, inform the Complainant of the availability of supportive measures with or without the filing of a formal complaint, and explain to the Complainant the process of filing a formal complaint.

When the Title IX Coordinator receives a formal complaint or signs a formal complaint, the District will follow its grievance process, as set forth in Policy 2266: Nondiscrimination on the Basis of Sex in Education Programs or Activities. Specifically, the District will undertake an objective evaluation of all relevant evidence-including both inculpatory and exculpatory evidence.

The District's Title IX Coordinator, along with any investigator(s), decision-maker(s), or person(s) designated to facilitate an informal resolution process must receive training on:

*the definition of sexual harassment (as that term is used in this policy)
*the scope of the District's education program or activity
*how to conduct an investigation and implement the grievance process appeals and informal resolution processes, as applicable; and 
*how to serve impartially, including by avoiding prejudgement of the facts at issue, conflicts of interests, and bias
